STATUTORY DECLARATION UNDER E-COMMERCE RULES: This document constitutes a legally binding policy formulated in strict adherence to Rule 4(11) and Rule 6(5) of the Consumer Protection (E-Commerce) Rules, 2020 framed under the Consumer Protection Act, 2019, read in conjunction with Section 16 and Section 41 of the Sale of Goods Act, 1930. Buyers are unequivocally notified that consecrated spiritual artifacts, botanical skin preparations, and hand-woven ritual textiles are governed by non-derogable hygiene, biological, and religious sanctity exemptions. Acceptance of delivery constitutes irrevocable assent to the inspection, verification, and non-returnable classifications delineated herein.
I

Philosophy of Consecration, Custodial Integrity & Strict Non-Resale Guarantee

All sacred commodities cataloged on KASHITVAM (https://kashitvam.com), an e-commerce enterprise operated by M/s. Rocklike Infratech (Udyam: UDYAM-UP-75-0129955, GSTIN: 09ACDPP1828L1ZA) from Varanasi, are processed, ritually handled, and sealed within a controlled, spiritually hygienic, and scripturally compliant environment. Our offerings are fundamentally intended for sanskaric invocation, personal Sandhyavandanam, deity abhishekam, temple aarti, and contemplative sadhana.

In ancient Dharmic jurisprudence (Shaucha) and modern consumer hygiene standards alike, a consecrated or personal spiritual artifact that has entered the private, domestic, or ritual custody of an external recipient cannot be returned into commerce, restocked, purified, or resold to another devotee. Re-introducing returned ritual goods into our dispatch pipeline would directly compromise our sacred covenant of untainted purity. Consequently, Kashitvam maintains an unyielding statutory framework that safeguards the religious integrity of our inventory while providing structured restitution for transit-borne damage or verifiable fulfillment errors.

II

Exhaustive Classification: Permanently Non-Returnable vs. Eligible Goods

Pursuant to Section 2(47) of the Consumer Protection Act, 2019, catalog lines are stratified into two mutually exclusive statutory classes:

🧵

Vedic Yajnopavita (Janeu)

Hand-spun unbleached indigenous cotton with sacred Brahma Granthi. Opening the sterile moisture-barrier thermal poly-seal renders the thread ritualistically unviable for subsequent devotees.

🌸

Tilaks, Kumkum & Pastes

Authentic Kashi Ashtagandha, Shastrokta Roli, Chandan paste, and Vibhuti Bhasm. Any canister with severed induction foils or unsealed lids is strictly barred to prevent biological contamination.

📿

Consecrated Wearable Malas

Single-strand daily wear Tulsi Kanthi Malas intended for direct cutaneous contact. Once unsealed, handled, or worn, items are exempt from return due to personal spiritual energization.

CLASS A: NON-RETURNABLE SACRED COMMODITIES
  • Vedic Yajnopavita: All 3-strand and 6-strand sacred cotton threads once sealed poly-wrap is breached.
  • Botanical Tilaks: Ashtagandha powder, pure Roli Kumkum, Chandan paste, and Sandalwood tika preparations.
  • Vibhuti Bhasm: Organic Gomaya Bhasm and sanctified temple ash once tamper-evident neck foil is removed.
  • Sacred Ganga Receptacles: Certified sealed Gangajal bottles sourced from the Varanasi ghats.
  • Wearable Intimate Malas: Single/multi-strand Tulsi Kanthi Malas once removed from vacuum packaging.
  • Ritual Consumables: Pure camphor tablets, cow ghee wicks, and opened puja havan sets.
CLASS B: CONDITIONALLY ELIGIBLE FOR RETURN / REPLACEMENT
  • Brass & Metallic Utensils: Brass diyas, akhand jyot lamps, puja ghanti, and aarti thalis with structural casting flaws.
  • Spiritual Meditation Rosaries: 108-bead Japa Malas (Tulsi / Rudraksha) strictly if intact with serialized security seal tags unbroken.
  • Fulfillment Discrepancies: Consignments differing from the generated commercial tax invoice.
  • Transit-Damaged Shipments: Broken glass, shattered brassware, or cracked containers substantiated by unboxing video proof.
III

Condition Precedent: 360-Degree Continuous Single-Take Unboxing Video

Under Section 65B of the Indian Evidence Act, 1872 (and corresponding provisions of the Bharatiya Sakshya Adhiniyam, 2023), digital video evidence forms the sole and indispensable factual basis for establishing pre-delivery damage, pilferage, or dispatch error.

MANDATORY 360° CONTINUOUS UNBOXING RECORDING MANDATE

The buyer covenants to record a continuous, unedited, single-take video prior to, during, and concluding the unpacking process. Failure to generate or furnish this continuous recording shall act as an absolute legal bar against any replacement, return, or missing item claim.

To qualify for statutory consideration, the unboxing recording must strictly satisfy each of the following cumulative parameters:

  1. Pre-Opening Exterior Audit: The recording must commence prior to cutting, tearing, slicing, or pulling any adhesive tape. The camera must pan across all four vertical sides, top, bottom, and show a clear, readable macro-zoom of the thermal courier shipping label (displaying the AWB barcode and recipient details).
  2. Single Unbroken Electronic Take: The video must be continuous and single-frame. Any cut, transition, splice, video pause, camera freeze, alteration, compression rendering, or post-production edit shall conclusively invalidate the submission as fabricated.
  3. Continuous In-Frame Extraction: The physical slitting of the security tape, unfolding of carton flaps, removal of bubble-wrap, and extraction of each individual sealed product container must remain fully in the center of the camera viewport.
  4. Defect Macro Demonstration: If transit damage, liquid spillage, shattered brass casting, or broken thread is observed, the operator must immediately hold the affected article before the camera lens, documenting the failure alongside the internal tax invoice.
IV

Statutory Dispute Window & Mandatory Intimation Protocol

In accordance with Section 42 of the Sale of Goods Act, 1930, the buyer is deemed to have accepted the delivered goods when an intimation of rejection is not lodged within a commercially reasonable period:

  • Strict 48-Hour Statute of Limitations: All claims of transit fractures, physical leakage, missing items, or dispatch mismatches must be formally registered within forty-eight (48) consecutive hours from the official electronic delivery timestamp provided by our integrated logistics API (Delhivery, Blue Dart, DTDC, Xpressbees, or India Post). Rejection of the consignment after 48 hours is statutorily time-barred.
  • Filing Vectors: Transmit your claim via email to care@kashitvam.com (cc: rocklikeinfratech@gmail.com) or WhatsApp Escalation Line (+91-9171727050) with the subject line: Fulfillment Dispute & Claim: [Order ID] - [Tracking AWB].
  • Required Evidentiary Enclosures: Attach the raw 360-degree unboxing video file (or unrestricted cloud storage link), high-resolution macro photos of the defect, and an image of the physical tax invoice slip found in the carton.
  • Internal Audit Protocol: Our Central Logistics Hub in Varanasi will review the video against packing CCTV surveillance, gross package weight logs, and dispatch scans within 24 to 48 business hours of receipt.
V

Reverse Transit Logistics, Bailment & Customer Obligations

Where a claim is authenticated by our logistics and quality audit team:

  • Zero-Cost Authorized Reverse Logistics: Kashitvam assumes 100% reverse shipping liability and arranges carrier pickup via contracted partners at zero freight cost to the consumer.
  • Bailment & Protective Packaging: Under Section 151 of the Indian Contract Act, 1872, the customer holds the rejected article as a bailee and must exercise standard care. The item must be repacked securely in its original structural carton reinforced with equivalent bubble wrap. If an item suffers secondary damage during return transit due to substandard customer packaging, the monetary loss will be deducted from eligible restitution.
  • Non-Serviceable Return Pincodes: In rural or remote areas lacking automated reverse-courier service, the customer will be authorized in writing to dispatch the parcel via India Post Speed Post (registered parcel with tracking). Upon delivery at our Varanasi depot and submission of the postal receipt, standard government postage costs will be reimbursed in full.
VI

VII

Doorstep Refusal, Return-to-Origin (RTO) & Anti-Fraud Defenses

  • Unwarranted Doorstep Rejection & RTO: If a buyer refuses delivery of a prepaid order without documenting demonstrable exterior damage with the courier agent, or if a consignment is returned to origin (RTO) after 3 failed delivery attempts resulting from incorrect addresses, phone non-responsiveness, or customer absence, the two-way logistics freight (outbound tariff + return transit cost) shall be deducted from the eligible refund balance.
  • Prosecution of Chargeback Fraud & Package Swapping: Any individual who institutes an unauthorized bank chargeback while possessing goods, or returns substituted synthetic articles, counterfeit malas, stone weights, or adulterated powders within the return consignment, shall face civil litigation for tortious conversion and criminal prosecution under Section 415, 420 (Cheating), and Section 403 (Dishonest Misappropriation) of the Indian Penal Code, 1860 (and corresponding provisions of the Bharatiya Nyaya Sanhita, 2023).
VIII

In no event shall Kashitvam, M/s. Rocklike Infratech, its managing partners, or fulfillment associates be liable for the postponement, delay, or rescheduling of any religious ritual, puja, Upanayana Sanskar, Vivaha ceremony, or festive observance resulting from transit delays or missing articles.

The Firm’s aggregate financial liability under every statutory ground shall remain strictly capped to the actual net monetary consideration paid by the consumer for the specific disputed item.
