1. Identity of the Proprietary Entity, Declarations & Scope of Agreement
This digital marketplace, operating under the brand name “KASHITVAM” (accessible via https://kashitvam.com and associated sub-domains, mobile viewports, or digital application interfaces), is exclusively owned, administered, managed, and commercially operated by M/s. Rocklike Infratech, a partnership entity duly organized and existing under the laws of the Republic of India, with its principal corporate and operational headquarters located at Varanasi, Uttar Pradesh – 221005, India (hereinafter referred to interchangeably as “Kashitvam”, “The Firm”, “We”, “Us”, or “Our”).
These Terms & Conditions of Sale and Usage (“Terms”), in conjunction with our Privacy Policy, Shipping & Delivery Policy, and Returns & Refunds Policy, constitute the entire, final, and unalterable legal understanding between the Firm and any natural or legal person who browses, accesses, orders, or interacts with this portal (“User”, “Buyer”, “You”, or “Your”).
Any conditional, partial, or qualified acceptance of these Terms is categorically rejected. If you do not concur with each and every term, covenant, representation, and warranty set forth herein, you are statutorily commanded to terminate your session, abstain from executing commercial purchases, and cease accessing our digital assets immediately. Continued usage constitutes unequivocal ratification of these Terms.
2. Legal Competence, Contractual Capacity & Access Mandates
Commercial transactions and account registrations on Kashitvam are governed by Section 11 of the Indian Contract Act, 1872. By proceeding to use this website, you explicitly declare, warrant, and covenant that:
- Majority & Capacity: You are an individual of sound mind, who has attained the age of eighteen (18) years, and are otherwise fully competent and legally qualified to enter into binding, valid, and enforceable contracts under prevailing Indian jurisprudence.
- Minors & Supervised Use: If you are under eighteen (18) years of age, you may browse this portal solely under the direct supervision and express consent of a parent or legal guardian who agrees to be bound by these Terms. The Firm reserves the peremptory right to terminate your registration, cancel pending orders, or refuse platform access upon discovery that contractual capacity is compromised.
- Account Integrity & Impersonation: You are strictly forbidden from impersonating any individual, entity, or spiritual trust, or creating fictitious credentials. All credentials, passwords, two-factor authorizations, and access vectors associated with your account are your sole fiduciary responsibility. Any purchase, checkout authorization, or communication initiated through your authenticated account shall be conclusively presumed to have been authorized by you, rendering you solely responsible for financial settlements.
- Commercial & Bulk Wholesaling: Users engaging in commercial resale, temple supply procurement, or bulk distribution must execute our dedicated B2B covenants, possess valid GSTIN registrations, and conform to the taxation structures defined under the Central Goods and Services Tax Act, 2017.
3. Sacred Artifacts, Botanical Preparations & Inherent Material Disclaimers
Kashitvam specializes in the curation, handcrafted preparation, and pan-India distribution of Vedic items, sacred threads (Yajnopavita), certified botanical tilaks (Ashtagandha, Roli, Chandan), ritual wicks, sacred river collections (Gangajal), Vibhuti Bhasm, and organic rosaries (Tulsi Kanthi Malas, Japa Malas, and Rudraksha beads) originating from the cultural geography of Varanasi. Due to the sacred, handcrafted, and biological nature of these offerings, you accept and agree to the following contractual conditions:
- Artisanal & Botanical Idiosyncrasies: The goods cataloged on Kashitvam are not mass-manufactured synthetic commodities. Sacred threads are hand-spun from indigenous unbleached cotton; rosary beads are harvested from holy basil timber and natural botanical seeds; tilaks are derived from natural plant compounds. Consequently, natural variances in texture, wood grain, fiber thickness, natural wood fissures, herbal aromatics, and biological coloration are conclusive hallmarks of untainted authenticity. Such variations shall never be legally construed, categorized, or claimed as manufacturing defects, deviations, or non-conformities under consumer protection standards.
- Compliance with the Legal Metrology Act, 2009: In accordance with the Legal Metrology (Packaged Commodities) Rules, 2011, all declared weights, dimensions, count of beads, and thread lengths are subject to reasonable, allowable tolerances inherent in hand-loomed and organically gathered botanical artifacts.
- Strict Disclaimer under the Drugs & Magic Remedies Act, 1954: In stringent compliance with the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 and applicable health statutes, Kashitvam expressly declares that no sacred thread, mala, vibhuti, gangajal, or yantra sold on this platform is represented, marketed, or intended as a therapeutic medicine, pharmaceutical treatment, cure, psychological remedy, or supernatural talisman for any physical disease, psychological condition, or financial misfortune. Spiritual efficacy, sanskaric alignment, and astrological resonances are purely matters of subjective theological belief, ancestral parampara, and personal devotion. The Firm categorically repudiates any liability regarding supernatural claims or subjective spiritual expectations.
- Allergy & Topical Disclaimers: While our tilak powders, chandan pastes, and vibhuti preparations are processed using natural botanicals without synthetic parabens, individual skin sensitivities, dermatological conditions, and allergies may occur. Users are legally obligated to execute a dermatological patch test prior to prolonged cutaneous application. Kashitvam and M/s. Rocklike Infratech shall not be held liable for personal dermatological reactions or misuse of ritual powders.
4. Pricing Structure, Invoicing, Tax Declarations & Unilateral Cancellation Rights
Commercial transactions, price computations, and order processing protocols are governed strictly by the following provisions:
- Statutory Tax Integration: All listed prices for end-consumers are stated in Indian National Rupees (INR) and incorporate applicable Goods and Services Tax (GST) as mandated by the relevant State and Central tax schedules. Separate commercial invoices showing the breakdown of CGST, SGST, or IGST shall accompany each dispatched package.
- Dynamic Pricing & Modifications: The Firm reserves the unfettered commercial discretion to adjust catalog pricing, promotional rebates, and bundle packaging without prior unilateral notice, reflecting fluctuations in raw cotton procurement, botanical harvest costs, or logistics surcharges. Such adjustments shall not affect orders that have already received official dispatch confirmation.
- Typographical, Algorithmic & Clerical Errors: In the event that a catalog item is erroneously listed at an inaccurate price, distorted product quantity, or zero-cost due to algorithmic failure, human clerical error, database unsynchronization, or server corruption, the Firm explicitly reserves the unconditioned, unilateral right to refuse, void, or rescind such orders. This right persists regardless of whether an automated confirmation was generated or funds were debited by the payment gateway. In every such circumstance, our sole and exclusive obligation shall be the prompt remittal of the full debited sum back to the original source instrument within standard banking timelines.
- Right to Restrict or Cancel Suspicious Orders: The Firm reserves the absolute right to cancel any order without assigning reasons if we reasonably detect signs of speculative booking, algorithmic bot checkouts, retail arbitrage, unauthorized reselling, geographical impossibility of delivery, or history of fraudulent Cash-on-Delivery (COD) abuse.
5. Payment Gateway Architecture, Safe Harbor & Financial Neutrality
To ensure secure transactions, Kashitvam incorporates banking aggregators and payment facilitators compliant with the Payment Card Industry Data Security Standard (PCI-DSS):
- Zero Retention of Sensitive Card Data: The Firm does not capture, store, log, or maintain records of sensitive banking credentials, Card Verification Values (CVV), Net Banking passwords, or Unified Payments Interface (UPI) secure MPINs on its servers. All financial processing is offloaded to RBI-authorized payment processors via end-to-end encrypted tunnels.
- Transaction Failures & Double Debits: In scenarios involving financial debits unaccompanied by an order generation (double debits, network drops, or gateway timeouts), the resolution rests with your issuing banking institution and the payment switch aggregator. While our customer care desk will provide transaction trace IDs upon request, Kashitvam disclaims all liability for intermittent bank downtime, false fraud flags by payment gates, or localized transaction failures.
- Chargeback Fraud Defense: Any customer who institutes a fraudulent chargeback, payment dispute, or bad-faith refund claim while possessing the dispatched goods shall be subjected to formal civil litigation for recovery alongside criminal complaints under Section 415 (Cheating) and Section 420 of the Indian Penal Code, 1860 (and corresponding sections under the Bharatiya Nyaya Sanhita, 2023).
6. Title, Transit Risk, Fulfillment & Courier Interface
Logistical operations, pan-India courier carriage, and domestic fulfillment are governed by the specific rules outlined in our Shipping & Delivery Policy, reinforced by the following legal boundaries:
- Passing of Title & Risk of Loss: For prepaid orders, title of ownership and risk of loss pass to the customer upon handover of the sealed consignment to our third-party logistics courier partners (such as Delhivery, Bluedart, Xpressbees, or India Post). The courier acts as an independent bailee under the Carriers Act, 1865.
- Tamper-Evident Packaging Protocol: Customers are legally instructed never to accept packages that show evident signs of tampering, slicing, wetness, or broken holographic seals. Acceptance of a visibly compromised package from the delivery agent without recording an explicit negative remark on the physical or electronic Proof of Delivery (POD) conclusively invalidates any future claim regarding transit pilferage or missing products.
- Mandatory Video Evidence for Claims: To prevent fraudulent claims of missing sacred artifacts, the customer must record a continuous, unedited 360-degree video of unboxing the package, starting from the inspection of the shipping label and intact outer seal down to the extraction of the products. Failure to provide continuous video documentation shall constitute a forfeiture of any claim regarding missing, erroneous, or transit-damaged items.
7. Non-Returnable Sacred Sanctity & Hygiene Restrictions
Under Section 2(47) of the Consumer Protection Act, 2019, e-commerce entities are permitted to delineate classes of products exempt from standard return covenants based on hygiene, customization, and ritual sanctity:
8. Intellectual Property, Trademarks, Brand Protection & Anti-Piracy
The visual and textual presentation of Kashitvam represents substantial artistic, creative, and commercial capital owned by M/s. Rocklike Infratech:
- Statutory Trademark Protection: The brand name “KASHITVAM”, the distinctive corporate emblem (depicting the sacred Kalpavriksha/Banyan silhouette intertwined with the sanctified Vedic flame and tilak motif), the slogan “The Essence of Sacred Kashi”, and regional scriptural combinations are proprietary trademarks owned by M/s. Rocklike Infratech, protected under the Trademarks Act, 1999. Any unauthorized reproduction, imitation, phonetic approximation, or deceptive similarity shall constitute willful infringement.
- Copyrights in Literary & Visual Works: Under the Copyright Act, 1957, all digital assets, professional product photography, macro bead imagery, textual descriptions, custom CSS stylesheets, UI ribbons, scriptural blog compositions, and layout structures accessible across this website are copyrighted creations. Automated web-scraping, data harvesting, image hot-linking, crawling via automated bots, and unauthorized replication for third-party e-commerce listings are strictly prohibited.
- Remedies for Breach: The Firm reserves the absolute right to institute urgent civil suits for interim and permanent injunctions, recovery of punitive damages, rendition of accounts, and criminal prosecution under Section 63 of the Copyright Act, 1957 and Section 103/104 of the Trademarks Act, 1999 against any infringing party.

Any violation of these covenants shall result in immediate termination of platform privileges and reference to law enforcement agencies under Sections 43, 66, and 66D of the Information Technology Act, 2000.
10. Intermediary Safe Harbor & Third-Party Linkage
In terms of Section 79 of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the platform claims safe harbor protections regarding user-generated feedback, independent payment gateway interfaces, and third-party tracking portals. While we strive to ensure the accuracy of all hyperlinked platforms (such as payment gates or logistical trackers), the Firm exerts no operational control over external websites, makes no representations concerning their security protocols, and shall not be liable for damages stemming from interactions on external landing pages.
11. Limitation of Liability & Exclusion of Consequential Damages
To the fullest extent permissible under applicable Indian law, you acknowledge and agree that:
- Exclusion of Consequential Losses: In no event shall Kashitvam, its parent entity M/s. Rocklike Infratech, partners, executive directors, employees, logistical associates, or upstream artisan partners be liable for any indirect, special, punitive, incidental, exemplary, or consequential damages whatsoever (including loss of profits, emotional distress, ritual postponement, business interruption, or data loss) arising out of or in connection with the purchase, usage, non-delivery, delayed delivery, or performance of products procured through this website.
- Liquidated Financial Ceiling: Without prejudice to the foregoing, should a court of competent jurisdiction find the Firm liable for any breach, our cumulative aggregate liability under contract, tort (including negligence), statutory warranty, or otherwise shall be strictly limited and capped to the actual monetary sum paid by the customer for the specific product directly giving rise to the controversy.
12. Indemnification Covenant
You agree to defend, indemnify, and hold harmless Kashitvam, M/s. Rocklike Infratech, its managing partners, affiliates, agents, legal counsel, and employees from and against any and all claims, actions, suits, penalties, fines, losses, liabilities, costs, and expenses (including full advocate fees and litigation expenditures) arising out of or resulting from:

- Your violation of any applicable Central, State, or international law, rule, or regulation;
- Your infringement of any third-party intellectual property, privacy, or publicity rights;
- Any fraudulent or malicious act executed through your authenticated user account.
13. Force Majeure & Doctrine of Frustration
In accordance with Section 56 of the Indian Contract Act, 1872, neither Kashitvam nor M/s. Rocklike Infratech shall be deemed to be in breach, default, or held legally accountable for any failure, impediment, disruption, or delay in executing orders, handling logistical shipments, or providing portal access if such failure arises from causes beyond our reasonable control (a “Force Majeure Event”).
A Force Majeure Event shall include, but is not limited to: acts of God, flood, earthquake, extreme seasonal downpours, riverine turbulence affecting ghat sourcing, epidemic or pandemic outbreaks, national or localized lockdowns, state declarations, transport blockades, labor unrest, strikes, internet gateway breakdowns, localized cyber warfare, or severe governmental import/export sanctions. - Severability: If any provision, clause, or covenant of these Terms is adjudged by a competent court to be unlawful, void, invalid, or unenforceable, such determination shall affect solely that specific provision without impairing the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.
- No Implied Waiver: The failure or delay by Kashitvam to enforce strict performance of any provision of these Terms shall not be construed as a waiver of our legal right to assert or rely upon that provision or any other legal remedy on subsequent occasions.
